Pelanggaran Kode Etik Penyelenggara Pemilu Pada Pemilihan Kepala Daerah Ditinjau dari Hukum Islam
Abstrak
Data pelanggaran kode etik Penyelenggara Pemilu hingga tahun 2020 cenderung meningkat. Sementara DKPP sudah memberikan sanksi yang cukup tegas. Kemungkinan semakin bertambah mengingat pilkada serentak pada tahun 2020 dalam pandemic covid. Pokok permasalahan tulisan ini terkait pengaturan kode etik ditinjau dari Hukum Islam serta permasalahan pelanggaran Kode Etik oleh Penyelenggara Pemilu. Mayoritas Penyelenggara, Peserta Pemilu dan Pelapor dalam sidang kode etik mayoritas beragama Islam, maka menarik dikaji dengan analisis yuridis normatif. Islam tidak mengenal pemisahan yang tegas antara hukum dan etika. Etika adalah bagian dari akhlak yang menyangkut perilaku manusia yang bersifat lahiriah, juga mencakup hal yang lebih luas, yaitu akidah, ibadah, dan syariah. Pelanggaran kode etik Penyelenggara Pemilu dapat dicegah dengan menjalankan nilai takwa oleh para penyelenggara dan peserta pemilu, dan masyarakat pemilih, dengan mengarah pada tiga aspek, yaitu akhlak al-karîmah, uswatun hasanah dan rahmatun li al-‘âlamîn.
