PROBLEMATIKA PENUNDAAN PEMILIHAN KEPALA DAERAH DALAM PEMILIHAN UMUM SERENTAK NASIONAL 2024
Abstrak
Permasalahan yang menarik dikaji dalam artikel ini, pertama, problematika penundaan Pilkada pada tahun 2024 bagi 271 daerah yang akan berakhir pada tahun 2022 dan 2023 dalam perspektif demokrasi dan otonomi daerah. Kedua, urgensi perpanjangan masa jabatan kepala daerah hingga tahun 2024. Kajian dalam tulisan ini bersifat normatif dengan pendekatan perundang-undangan. Hasil analisis terhadap permasalahan tersebut menyimpulkan, pertama, penundaan Pilkada dari tahun 2022 dan 2023 ke tahun 2024 akan mengakibatkan terjadinya kekosongan jabatan kepala daerah di 271 daerah. Di samping itu, pengangkatan penjabat kepala daerah yang akan memimpin selama satu sampai dua tahun memberikan ketidakpastian terhadap demokrasi di daerah, dan mencederai prinsip otonomi daerah. Kedua, untuk menghindari pengisian penjabat kepala daerah di 271 daerah
diperlukan langkah yang lebih demokratis berupa perpanjangan masa jabatan selama satu atau dua tahun sesuai batas akhir masing-masing daerah, yaitu dilakukan dengan jalan merevisi UU Pemilihan Gubernur, Bupati dan Walikota.
