KEDUDUKAN DKPP SEBAGAI PENEGAK ETIKA YANG BERMUATAN HUKUM

Abstrak

Dewan Kehormatan Penyelenggara Pemilu (DKPP) merupakan lembaga yang berperan penting dalam menegakkan kode etik penyelenggara pemilu di Indonesia. Meskipun berfokus pada aspek etik, DKPP memiliki kekuatan yuridis yang kuat melalui kewenangan menjatuhkan sanksi berupa pember- hentian tetap kepada penyelenggara pemilu. Tulisan ini bertujuan menga- nalisis kedudukan DKPP dalam sistem hukum Indonesia, menyoroti karak- teristik etika yang bermuatan hukum, serta meninjau implikasi hukum dari putusannya. Hasil kajian menunjukkan bahwa DKPP beroperasi di antara ruang etika dan hukum, mengisi kekosongan antara pelanggaran moral dan pelanggaran hukum positif, sekaligus menjaga legitimasi penyelenggaraan pemilu.
