CHARACTERISTICS OF LEGAL AND ETHICAL REASONING IN DKPP DECISIONS: ANALYSIS OF CASES OF IMMORTAL ACTS
Abstract
This research analyzes DKPP decisions using legal and ethical reasoning approaches as the fundamental foundation. The research problems are: first, what are the characteristics of legal and ethical reasoning in DKPP decisions? Second, what are the implications of DKPP decisions related to immoral conduct? This research is normative research using statutory, con- ceptual, and case approaches. The results of this research are: first, DKPP decisions have different characteristics and reasoning models in each deci- sion. DKPP Decision Number: 327-PKE-DKPP/XII/2019 employs Le- gal Positivism and Ethical Positivism reasoning models; DKPP Decision Number: 42-PKE-DKPP/IV/2020 uses Legal Realism and Ethical Real- ism reasoning models; DKPP Decision Number 16-PKE-DKPP/I/2021 utilizes Historical School reasoning model and also applies analogical rea- soning method; and DKPP Decision Number 145-PKE-DKPP/VII/2024 employs Legal and Ethical Utilitarianism reasoning model. Second, the im- plications of DKPP decisions related to immoral conduct can take the form of Landmark Decisions and ethical jurisprudence.
