KODE ETIK DAN INTEGRITAS PEMILU: MENAKAR KEWENANGAN DKPP DALAM PENEGAKAN PEMILU INDONESIA

Abstrak

DKPP sebagai lembaga penegakan kode etik pemilihan umum (pemilu) memiliki tanggung jawab untuk menjaga integritas dalam bekerja sebagai manifestasi karakter penting dalam penyelenggaraan pemilu. Penelitian ini bertujuan menganalisis batasan kewenangan DKPP dalam penegakan etik pemilu dan mengkaji perluasan sanksi etik yang telah diputuskan oleh DKPP. Dalam penelitian ini menggunakan metode yuridis normatif den- gan menggunakan bahan hukum primer, sekunder, dan tersier serta dia- nalisis secara kualitatif. Hasil penelitian ini menyimpulkan bahwa peran DKPP tidak hanya berfokus pada rule of law, tetapi juga pada rule of eth- ics. Namun, dalam melaksanakan tugas dan kewenangan, DKPP perlu ber- hati-hati dalam menafsirkan dan memperluas sanksi etika terhadap penye- lenggara pemilu di Indonesia agar tetap dalam batas jalur kewenangannya.
